How it delta 8 legal?
The 2018 Hemp Farm Bill allows for the manufacturing and sale of any product derived from hemp containing less than 0.3% Delta-9-THC, the main psychoactive ingredient in marijuana, which means that yes, federally, Delta 8 is legal.
Delta 8 is special for some states
But, there’s a caveat. Some states have different regulatory laws that ban any and all hemp products. So, if you live in Alaska, Arizona, Arkansas, Colorado, Delaware, Idaho, Iowa, Mississippi, Montana, Rhode Island, and Utah, unfortunately, D8 is not legal.
Drug testing with Delta 8
Another thing to keep in mind that although you may live in a state where D8 is legal, because of how similar it is to Delta 9, there is a relatively good chance that you would fail a drug test. This is because drug tests, primarily pee tests, do not test for the cannabinoids THC Delta-9 specifically, they test for a metabolite of delta-9-THC and thus the metabolites may look too similar.
What does the future of Delta 8 look like?
